A Qualified Domestic Relations Order (QDRO) as that term is defined in §414(p) of the Internal Revenue Code of 1986 (Code), as amended, §206(d)(3) of the Employee Retirement Income Security Act of 1974 (ERISA), and Illinois law. A QDRO is required for the separation of any private pension. An Illinois Domestic Relations Orders (QILDROs) are Illinois court orders that direct a government pension plan (e.g., Teachers Retirement System) to pay a portion of a member’s benefit or refund to an alternate payee, typically a former spouse. QILDROs are issued under the Illinois Pension Code, 40 ILCS 5/1-119.
